Terms of Service

These Terms are an agreement between you and Levelford Australia Pty Ltd (ABN 38 698 794 740) governing your use of Empire Builder and empirebuilder.cloud (the "Service"). By creating an account or using the Service you agree to them. Read with our Privacy Policy and End-to-End Guarantee & Your Consumer Rights.
1. Your account
Be 18+ and able to contract. Give accurate details and keep your login secure; you're responsible for activity on your account — tell us at support@empirebuilder.cloud if you suspect misuse.
2. Using the Service
Lawful business and personal use only. Don't break the law, infringe rights, upload harmful content, disrupt or reverse-engineer the Service, gain unauthorised access, or resell/sublicense except as we permit.
3. Your content & our IP
You keep ownership of what you create or upload, and grant us a limited licence to host and process it only to provide the Service. The Service itself (software, design, text, branding) belongs to us or our licensors; you get a personal, non-exclusive, non-transferable right to use it while these Terms apply.
4. Fees and payment
Current prices are shown at checkout and on the pricing page. Empire Builder is a one-time purchase, not a subscription — no auto-renewal, no recharge of your payment method. This applies to every purchase: the Base, and any optional add-on you buy later (a Business, a Department, or a Tasks & Teams tool) are each separate one-time purchases you actively confirm. Price changes never affect a completed purchase.
5. Satisfaction
If you're not satisfied within 14 days of purchase, contact us and we'll refund your payment. This does not limit your rights under the Australian Consumer Law. See End-to-End Guarantee & Your Consumer Rights.
6. Your consumer rights (ACL)
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where permitted, our liability for breach of a consumer guarantee is limited (at our option) to re-supply or its cost. The clauses below apply only as far as the law allows and never reduce your non-excludable rights.
7. "As is", liability & indemnity
Except for your clause 6 rights, the Service is provided "as is"; we don't guarantee it is uninterrupted or error-free. Subject always to clause 6, to the extent permitted by law we aren't liable for indirect or consequential loss, and our total liability for any claim is limited to the greater of the fees you paid in the prior 12 months or AUD $100. To the extent permitted by law, you cover reasonable losses we suffer from your unlawful use or breach.
8. Suspension, changes & governing law
You may close your account anytime. We may suspend or end access for material breach or unlawful use, generally after notice. We'll give reasonable notice of material changes. These Terms are governed by the laws of New South Wales, Australia; you and we submit to the non-exclusive jurisdiction of its courts. This does not remove mandatory consumer-law protections in your home jurisdiction.
